Lauren Fitzgerald and Jay Thompson to Present on Environmental Forensic Tools for Litigation Support at Southeastern Environmental Law & Regulation Conference

Lauren Fitzgerald, Ph.D., P.E. (Georgia) and Jay Thompson, Ph.D., P.E. (Minnesota) will present "Using Environmental Forensic Tools for Litigation Support" at the 28th Annual Southeastern Environmental Law & Regulation Conference at the Sandestin Golf and Beach Resort in Miramar Beach, Florida from 3:15-4:00 pm on June 14, 2019.

Lauren and Jay will co-present with W. Larkin Radney, IV, Esq. of Lightfoot, Franklin & White, LLC.

Lauren is an Environmental Engineer based in North Carolina focused on contaminated site investigation and remediation. Her experience includes environmental site characterization and forensics at numerous large sediment cleanup sites in the U.S. Lauren has been involved in litigation projects as technical support in contaminant and site historical forensics to evaluate liability and support allocation.

Jay is an Environmental Engineer based in Minnesota focused on environmental forensics, contaminant bioavailability, and contaminant fate and transport. He has consulted on some of the largest sediment mega-sites across the U.S., applying this technical expertise to advise his clients on nexus, allocation, and managing potential environmental liabilities.

The Southeastern Environmental Law & Regulation Conference is sponsored by the Environmental Law Section of the Alabama State Bar and the Section on Natural Resources, Energy, and Environmental Law of the Mississippi State Bar. The conference provides a forum for the legal and technical communities to communicate best practices with respect to environmental remediation, regulatory compliance, and litigation.

Abstract

Environmental forensics is the science of utilizing analytical, statistical, and historical research methods to identify connections between environmental impacts and applicable contaminant sources at a site. This field of study involves the evaluation of analytical data in conjunction with a review of site ownership/operational history information and evidence of contaminant release pathways to establish nexus and inform legal strategy. Applications of environmental forensics aim to understand the nature and extent of impacts at contaminated sites and can serve as integral tools for client liability valuation and cost allocation. This talk will include case studies in which environmental forensics techniques were successfully applied to matters of PRP negotiation, cost allocation and active litigation.
